Where do you have the rule from?
Could you possibly share a screenshot? Maybe it looks different on your system. It definitely does not look that well on Windows XP as on newer systems, but I do not consider it that bad though.
The tabs have standard Windows tab color.
They are located above a part of the window they are changing (file panels). I believe that's the correct place.
Just as in web browsers: Above webpage and address bar, below menu.
When a button is important, it's not iconized.

Maybe the icon looks good on certain Windows version (not on XP) but again, the program does not look serious

Also: the session tabs should be relocated, either as the first row (below menu) or the last row, and its row should have a darked bgcolor since it's not a toolbar, it's a tabs bar.
